Terms and Conditions

1. Definitions

In these Terms, the following definitions apply:

• "Products" refers to all peptides, research chemicals, and related materials offered for sale on the Site.
• "Customer," "you," or "your" refers to any individual or entity that accesses the Site or purchases Products.
• "Order" refers to any request to purchase Products submitted through the Site.
• "Research Use" means use in bona fide scientific research conducted in a properly equipped laboratory setting by qualified personnel.

2. Eligibility and Purchaser Representations

By placing an Order, you represent and warrant that:

• You are at least 18 years of age (or 21 years of age where required by applicable law);
• You possess the legal capacity to enter into a binding contract;
• You are purchasing Products solely for legitimate Research Use;
• You will not use, sell, distribute, or otherwise transfer any Products for human or animal consumption, therapeutic purposes, or any unlawful purpose;
• You have the knowledge, training, and equipment necessary to safely handle research chemicals and peptides;
• You will comply with all applicable federal, state, and local laws and regulations regarding the possession, handling, storage, and use of the Products; and
• All information you provide to us is accurate, current, and complete.

3. Products and Product Information

All Products are sold for Research Use only and are not approved for human or veterinary use by the U.S. Food and Drug Administration (FDA) or any other regulatory authority. We make reasonable efforts to ensure that product descriptions, specifications, and images are accurate. However, we do not warrant that product descriptions or other content on the Site are accurate, complete, reliable, current, or error-free. Products may vary slightly from images shown.

We reserve the right to modify, discontinue, or change pricing for any Product at any time without prior notice. Current pricing supersedes all previously published pricing.

4. Orders and Acceptance

Submitting an Order constitutes an offer to purchase Products subject to these Terms. All Orders are subject to acceptance by the Company. We reserve the right to refuse or cancel any Order for any reason, including but not limited to: product availability, errors in product or pricing information, suspected fraudulent activity, or concerns regarding intended use.

An Order is not accepted until we send a shipping confirmation email. We may require additional verification of your identity or intended use before processing an Order.

5. Pricing and Payment

All prices are listed in U.S. Dollars (USD) unless otherwise indicated. Prices do not include applicable taxes, shipping, or handling charges, which will be calculated and added at checkout. You agree to pay all charges incurred in connection with your Order at the prices in effect when such charges are incurred.

Payment must be made in full at the time of Order using an accepted payment method. We accept major credit cards, cryptocurrency, and other payment methods as indicated on the Site. All payments are processed through secure third-party payment processors.

6. Shipping and Delivery

We ship to addresses within the United States and select international destinations. Shipping times are estimates only and are not guaranteed. We are not responsible for delays caused by customs, carrier issues, weather, or other circumstances beyond our control.

Risk of loss and title to Products pass to you upon delivery to the carrier. You are responsible for inspecting all shipments upon receipt and reporting any damage or discrepancies within 48 hours.

7. Returns and Refunds

Due to the nature of our Products and the importance of maintaining chain of custody for research materials, all sales are final. We do not accept returns of opened Products. Unopened Products may be returned within 14 days of delivery for store credit only, subject to a 15% restocking fee. Products must be returned in original, sealed packaging.

If you receive a damaged or defective Product, please contact us within 48 hours of delivery with photographic evidence. We will, at our sole discretion, either replace the Product or issue a refund.

8. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, product descriptions, and software, is the property of FastPeps or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

9. Limitation of Liability

To the fullest extent permitted by applicable law, FastPeps, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the site, purchase of products, or these terms, regardless of the theory of liability.

Our total liability to you for all claims arising from or related to these terms or your use of the site or products shall not exceed the amount you paid for the specific product giving rise to the claim.

10. Disclaimer of Warranties

The site and all products are provided "as is" and "as available" without warranties of any kind, express or implied. We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected. We make no representations regarding the safety, efficacy, or suitability of Products for any particular research application.

11. Indemnification

You agree to indemnify, defend, and hold harmless FastPeps, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Site; (b) your purchase, possession, handling, storage, or use of any Products; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) your violation of any rights of any third party.

12. Compliance with Laws

You are solely responsible for ensuring that your purchase, possession, and use of Products complies with all applicable federal, state, local, and international laws and regulations. Certain Products may be regulated or prohibited in certain jurisdictions. It is your responsibility to verify the legality of purchasing and possessing Products in your jurisdiction before placing an Order.

13. Privacy and Communications

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and protection of your personal information.

13.1 SMS Communications

By providing your phone number and opting in at checkout, you consent to receive automated transactional text messages (SMS) from FastPeps regarding your order, including order confirmation, payment receipt, and shipping updates. 14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site or Products shall be resolved exclusively in the state or federal courts located in Delaware, and you hereby consent to the personal jurisdiction of such courts.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' original intent.

16. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by an authorized representative of FastPeps.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and FastPeps regarding the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

18. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site or purchase of Products after any such changes constitutes your acceptance of the modified Terms. We encourage you to review these Terms periodically.
